1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and HomeFixAI ("Company," "we," "us," or "our") governing your access to and use of the HomeFixAI mobile application ("App") and related services.

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. Eligibility

You must be at least 18 years old to use HomeFixAI. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Description of Services

HomeFixAI provides:

• AI-Powered Diagnosis: Upload photos of home issues to receive AI-generated assessments of potential problems
• Repair Guides: Step-by-step instructions for common home repairs
• Cost Estimates: Approximate costs for DIY repairs versus hiring professionals
• Maintenance Reminders: Scheduled notifications for routine home maintenance tasks
• Repair History: Track your completed repairs and savings
• Achievement System: Gamification features to track your DIY progress

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account
• Not share your account credentials with others

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused.

5. Subscription Plans and Billing

5.1 Free Tier

New users receive 3 free AI diagnoses. Once exhausted, a paid subscription is required for additional diagnoses and premium features.

5.2 Paid Subscriptions

We offer the following subscription options:

• Weekly Plan: $5.99 per week with automatic renewal
• Monthly Plan: $19.99 per month with automatic renewal

All subscriptions are processed through Apple's App Store. Payment will be charged to your Apple ID account upon confirmation of purchase.

5.3 Automatic Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

5.4 Cancellation

You may cancel your subscription at any time through your Apple ID account settings (Settings → [Your Name] → Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period.

5.5 Refunds

Refund requests are handled according to Apple's App Store refund policies. To request a refund, visit reportaproblem.apple.com within the applicable refund window.

7. Assumption of Risk

By using HomeFixAI and attempting any repairs based on information provided through the App, you expressly acknowledge and agree that:

• Home repairs involve inherent risks including personal injury, property damage, and other hazards
• You are solely responsible for assessing whether any repair is appropriate for your skill level
• You assume full responsibility for your decision to attempt any repair
• You will follow all safety guidelines and use appropriate protective equipment
• You will comply with all applicable building codes, permit requirements, and regulations
• You will immediately stop and seek professional help if you encounter unexpected situations
• AI diagnoses may not be 100% accurate and should be verified by a professional when in doubt

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• HOMEFIXAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ITS CONTENT
• WE SHALL NOT BE LIABLE FOR INACCURATE DIAGNOSES, REPAIR FAILURES, OR COSTS INCURRED FROM ATTEMPTED REPAIRS
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM

Some jurisdictions do not allow limitations on liability, so the above limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless HomeFixAI, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any repairs you attempt based on information from the App.

10. Intellectual Property

The App and all of its content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, video, software, AI models, and data compilations) are owned by HomeFixAI or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

You may not:

• Copy, modify, distribute, or create derivative works of App content
• Reverse engineer, decompile, or attempt to extract the source code or AI models
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for any commercial purpose without our written consent
• Use automated systems (bots, scrapers) to access or interact with the App

11. User Content

You retain ownership of photos and other content you submit to the App ("User Content"). By submitting User Content, you grant HomeFixAI a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, process, adapt, and display your User Content solely for the purpose of providing and improving our services.

You represent and warrant that: (a) you own or have the rights to submit the User Content; (b) the User Content does not violate any third-party rights; and (c) the User Content does not contain illegal or harmful material.

12. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any regulations
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the App's operation or servers
• Impersonate any person or entity or misrepresent your affiliation
• Share your subscription access with others
• Use the App to collect information about other users
• Submit false, misleading, or fraudulent information
• Circumvent any technological measures designed to protect the App

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms that should reasonably survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

14. Changes to Service and Terms

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time without notice. We may also update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in class action lawsuits against HomeFixAI.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HomeFixAI regarding the use of the App and supersede any prior agreements or understandings.
